Traffic School for Commercial Driver License Information - Pursuant to California Vehicle Code Section 42005 vc, starting on September 20, 2005, drivers with a commercial drivers license or drivers driving a commercial vehicle as defined in subdivision (b) of the Vehicle Code section 15210 are prohibited from attending traffic school and having the violation dismissed.
The traffic court MAY approve a request to attend traffic school for a commercial driver with a commercial driver’s license if the eligible violation offense occurred in a noncommercial vehicle. After completion of an approved program by a commercial driver with a commercial driver’s license, a conviction of the violation will appear on the driver's DMV driving record, but a point will not appear for the offense.
In California, if a driver holds a valid driver's license and is accused of a traffic violation for vehicle code infraction, the driver may be eligible to attend traffic school to keep the point from appearing on the DMV record. Traffic school is an 8-hour course providing defendants with information to make them more aware of California traffic laws and improves their driving skills. DMV will only mask one moving violation from the DMV driving record within an 18-month period. This 18-month period starts from the date the violation was issued to the date the second violation is issued and not from the date of traffic school attendance. If you a driver with a traffic violation decides not to attend traffic school, the driver's automobile insurance premium may be adversely affected.
The driver must pay a non-refundable traffic school fee equal to the traffic ticket bail amount plus an additional traffic school court fee (approx. $50 to $70, depending on county) to the traffic Court (VC 42007.1) to attend traffic school. Traffic schools are private businesses therefore, they will charge an additional traffic school course fee.
A driver cannot attend traffic school if one of the following applies:
The driver attended traffic school within the last 18 months of the alleged violation date.
The driver was accused of a violation involving alcohol or drug possession.
The driver failed to appear in court pursuant to California Vehicle Code section 40508(a) or California Penal Code section 1214.1.
The alleged violation has more than one DMV point penalty count pursuant to California Vehicle Code section 12810.
If there is a fix-it or a correctable violation on the traffic ticket, the driver must file the corrections with the traffic court along with traffic school court fee as indicated above. Then, after the traffic school course has been completed within the timeframe given by the court, the driver must submit the original traffic school certificate of completion to the court by the due date assigned by the court. In most California courts the certificate of completion may be filed in person or by mail or in certain courts electronically. If the driver does not complete traffic school a conviction for the violation will be placed on the DMV driving record.
