Trial by Written Declaration Tips and Instructions - According to California Vehicle Code section 40902 a defendant accused of a traffic infraction violation may select to contest his/her citation in writing, without personal appearance in traffic court.  This procedure is called a "trial by declaration".  Trials by written declaration are available in cases for minor traffic violations involving infractions of the Vehicle Code or of local (city or County) ordinances adopted under the Vehicle Code.  The following instructions provide information on how to obtain a trial by written declaration:
 
  1. First, it is critical to completely fill out the Request for Trial by Written Declaration (form TR-205) and sign it (type or print clearly) in the designated area.  You have the option to include evidence such as pictures, witness statements, diagrams and etc.  You should also attach a written statement of why you think the traffic ticket should be dismissed.  In the written statement or Declaration of Facts (item#6), you must clearly in writing explain all the items of evidence (if any) that you are including with your trial form-TR205. Your Declaration of Facts or written statement must include the following language:  "I declare under penalty of perjury that this statement is true and correct."  It is necessary for you to sign and date each written statement (these statements are called "declarations"). 
  2. You must return the completed and signed Request for Trial by Written Declaration to the traffic court and pay the required bail amount.  The completed TR-205 form and  the full required bail amount must be delivered (in person or mail) to the clerk by the due date indicated.  If the you do not submit the trial by written declaration form to the court by the due date, you will not be eligible for trial by written declaration. Also, it is important to note that if you do not deposit the full bail amount by the due date yo may subject you to other fees, charges, penalties, assessments, and actions. 
  3. After trial by written declaration form is submitted to the traffic court, the court clerk will inform the citation issuing officer about the request for a trial by written declaration. The citing officer will be provided with an opportunity to prepare and submit an officer's declaration for the traffic ticket by a due date given by the traffic court. Once the judge has had an opportunity to review both statements, the court will notify you by mail of the court's decision.
  4. If the court's decision is not to your satisfaction, you may decide to request for a new trial called ("trial de novo").  You must file the Request for New Trial (Trial de Novo) (form TR-220) within 20 days after the date the court's decision was mailed to you. 
  5. You must always include the traffic ticket number in any correspondence with the traffic court.
  6. IMPORTANT INFORMATION:  You have the right to have an in-person trial before a judge instead of a trial by written declaration.  You also have a right to have a new trial if you think the court decision was not to your satisfaction in the trial by written declaration.  If you choose a court trial, you will have the following rights: To be represented by an attorney employed by you; To have a speedy and public trial; To testify, to present evidence, and to use court orders without cost to compel the attendance of witnesses and the production of evidence on your behalf; To have the witnesses against you testify under oath in court, and to question such witnesses; To remain silent and not testify and not incriminate yourself.
